2. Collection and storage of personal data when visiting the website as well as the type and purpose of their use

When you access our website, the browser used on your end device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the file accessed,
  • Website from which the access was made (referrer URL),
  • Browser used and, if applicable, the operating system of your computer as well as the name of your access provider

The above data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • Evaluation of system security and stability, and
  • For other administrative purposes

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

3. Contact form

When using the contact form on our website, you are required to provide your first and last name, e-mail address and telephone number so that we can respond to your enquiry. We use personal data that you provide in this context solely for the purpose of contacting you and processing your enquiry. Your data will be deleted after we have completed processing your enquiry. This is the case when the circumstances indicate that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary. The legal basis for this data processing is art. 6 p. 1 GDPR. Our legitimate interest follows from the above-mentioned purpose of the data processing. If your contact is aimed at the conclusion of a contract, the additional legal basis for data processing is Art. 6 GDPR.

4. Live chat

The live chat function is available on our website. For this purpose, we use the 3CX Live Chat & Talk plugin from a third-party provider. When using the live chat, we collect information about your IP address as well as the content you send to us. We use this information for the sole purpose of being able to process your request. Your data will be deleted after we have completed processing your request. This is the case when it can be seen from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary. The legal basis for this data processing is Art. 6 p. 1 GDPR. Our legitimate interest follows from the above-mentioned purpose of the data processing. If your contact is aimed at the conclusion of a contract, the additional legal basis for the data processing is Art. 6 GDPR.

5. Newsletter

On our website you have the option of subscribing to a free newsletter. For this purpose, it is necessary to enter your e-mail address. When sending the newsletter, we use the services of third-party providers based in the USA, who may use your email address exclusively for the purpose of sending the newsletter on our behalf. The legal basis for this processing is your consent pursuant to Art. 6 p. 1 GDPR. For this purpose, we use the double opt-in procedure, by means of which you finally register for our newsletter via a confirmation link. Your data will be processed for the duration of the subscription.

Note on the right of withdrawal

You can revoke your consent at any time with effect for the future by sending a message to datenschutz@polmetal.de or using the unsubscribe option at the end of each newsletter.

Newsletter tracking

We use so-called newsletter tracking to evaluate the newsletter opening rate and your clicks within the newsletter. We use this technique to determine the level of interest in certain topics and to measure the effectiveness of our communication measures. The legal basis for the data processing is Art. 6 p. 1 GDPR. Our legitimate interest follows from the aforementioned purposes for data collection. The data is stored pseudonymously. We do not exchange this data with anyone and we do not make any attempt to associate the “click-throughs” with individual email addresses.

6. Cookies

We use cookies on our website. Cookies are small data packages that the browser you are using saves on your end device at our instigation. They do not cause any damage there. The data collected with the help of cookies is anonymised or pseudonymised – it is not possible for us to determine your identity on the basis of the stored data. Depending on the storage period, a distinction is made between session and permanent cookies. Session cookies are automatically deleted when you close your browser. The use of session cookies serves to make the use of our offer more pleasant for you. Permanent cookies, on the other hand, have a lifespan of up to 10 years (permanent cookies). Permanent cookies remain on your computer and enable us to recognise your computer the next time you visit us. These cookies in particular serve to make our offer user-friendly, more effective and safer.

7. Use of Google Analytics

Google Analytics is used on our website to collect information about the user behaviour of visitors to our website. The provider of Google Analytics is Google Inc. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (hereinafter: “Google”). Google Analytics is intended to provide us with insights into whether we are meeting the needs of the users of our website and what we can improve. In this context, pseudonymised usage profiles are created and cookies (see under point 6.) are used. Google uses cookies to store information about which pages you visit, how long you stay on the page, how you got there and what you click on. The cookies used by Google Analytics are: _utma, _utmb, _utmc, _utmz, _utmv _ga. _gid.

The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. The IP addresses are anonymised so that an assignment is not possible (IP masking). Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. Under no circumstances will your IP address be merged with other Google data. 8. Google Maps

Information about your use of our website (such as your IP address) is transferred to Google servers in the USA and stored there when you call up those sub-pages in which the Google Maps map is integrated. This occurs regardless of whether Google provides a user account via which you are logged in or whether no user account exists. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.

If you do not agree to the future transmission of your data to Google in the context of the use of Google Maps, you also have the option of completely deactivating the Google Maps web service by switching off the JavaScript application in your browser. Google Maps and thus also the map display on this website can then not be used.

9. YouTube

The video used for our company presentation on our website is stored on www.youtube.com and can be played directly from our website. When you call up the sub-pages in which the video content is embedded, information about your use of our website (such as your IP address) is transmitted to servers of Google as the operator of YouTube services, located in the USA, and stored there. This takes place regardless of whether Google or YouTube provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want your data to be associated with your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. 10. Data subject rights

According to the applicable data protection law, you are entitled to a wide range of rights of information and intervention with regard to the data concerning you if the respective legal requirements are met. In detail:

  • Pursuant to Art. 15 GDPR, you may request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details. You may also request meaningful information on the details of such decision-making, as well as on what guarantees exist in accordance with Article 46 of the GDPR in the event that your data is forwarded to third countries;
  • In accordance with Art. 16 GDPR, you may request the immediate correction of incorrect or incomplete personal data stored by us;
  • Pursuant to Art. 17 GDPR, you may request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
  • In accordance with Art. 18 GDPR, you may request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is being verified, if you refuse the deletion of your data due to unlawful data processing and instead request the restriction of the processing of your data, if you require your data for the assertion, exercise or defense of legal claims after we no longer need this data after the purpose has been achieved, or if you have lodged an objection on the grounds of your particular situation as long as it has not yet been determined whether our legitimate grounds prevail;
  • According to Art. 19 GDPR, we are obliged to inform all recipients to whom personal data have been disclosed of any rectification, erasure or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients;
  • In accordance with Art. 20 GDPR, you have the right to obtain the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller;
  • In accordance with Art. 7 GDPR, you may revoke your consent at any time. This has the consequence that we may no longer continue the data processing that was based on this consent for the future;
  • Pursuant to Article 77 of the GDPR, you may, without prejudice to any other administrative or judicial remedy, lodge a complaint with a supervisory authority if you consider that the processing of personal data concerning you infringes the GDPR. As a rule, you can contact the supervisory authority of your usual place of residence for this purpose.

11. Right of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

If our website contains links to external websites, this declaration does not apply to the data collection and use on the linked sites.
